Terms of Service

1. Agreement to Terms

By accessing or using the shallow coffee application, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, then you may not access the service.

2. Eligibility

You must be at least 18 years of age to create an account on shallow coffee and use the Service. By creating an account and using the Service, you represent and warrant that:

  • You are at least 18 years old.
  • You can form a binding contract with shallow coffee.
  • You will comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations.
  • You have never been convicted of a felony or any crime involving violence, sexual misconduct, or harassment.

3. Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of shallow coffee and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of shallow coffee.

4. User Conduct and Prohibited Activities

You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms. You specifically agree not to:

  • Use the Service in any manner that could disable, overburden, damage, or impair the Service.
  • Engage in any form of harassment, bullying, or abuse towards other users.
  • Post or transmit any content that is offensive, defamatory, obscene, or otherwise objectionable.
  • Attempt to gain unauthorized access to any portion of the Service or any other accounts.
  • Use any robot, spider, or other automatic device to access the Service for any purpose.

Zero Tolerance Policy: We have a zero-tolerance policy for abusive behavior and inappropriate content. Any user found to be engaging in harassment, hate speech, sharing illegal content, or displaying sexually explicit content during video calls will have their account immediately terminated.

5. Safety; Your Interactions with Other Users

Though shallow coffee strives to encourage a respectful member experience through features like video-first matching, it is not responsible for the conduct of any member on or off of the Service. You agree to use caution in all interactions with other members, particularly if you decide to communicate off the Service or meet in person.

YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER MEMBERS. YOU UNDERSTAND THAT SHALLOW COFFEE DOES NOT CURRENTLY CONDUCT CRIMINAL BACKGROUND CHECKS ON ITS MEMBERS OR OTHERWISE INQUIRE INTO THE BACKGROUND OF ITS MEMBERS. SHALLOW COFFEE MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT OF MEMBERS.

6. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

7. Limitation of Liability

In no event shall shallow coffee, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
